Government may file appeal with the WTO over Chinese ban on Taiwanese seafood

The Council of Agriculture says it is considering getting the World Trade Organization involved, after China suspended seafood imports from more than 100 Taiwanese companies.Earlier this year, China changed its customs rules with a requirement that all companies needed to register their products before they were granted permission to export to China. The council says Taiwan was given a considerable shorter timeline to adapt to the changes, and that so far only one seafood company has been able to obtain permission. It says it may file an appeal with the WTO on the grounds that China’s new registration system is in fact an administrative trade barrier.

Earlier this year, China introduced new rules for its imports, requiring all food exporters to register their products with the Chinese government. Since then, more than 100 Taiwanese seafood companies and fishing firms have sent the required documents to China. But according to the official webpage of China’s General Administration of Customs, only one company has been granted permission so far. That has put Taiwan’s seafood exports to China on halt.

They put tougher regulations in place for us. They wanted us to submit the necessary documentation before the end of August. For other countries, the deadline was June 30, 2023. I think this can be considered an administrative trade barrier by the WTO.

According to the Council of Agriculture, the products affected by the measures are worth about NT$6.5 billion. Squid products alone account for more than NT$3 billion of the total. Other products affected include fourfinger threadfin, skipjack tuna and Pacific saury.

We hope that the Food and Drug Administration under the Ministry of Health and Welfare will be able to enquire about this registration process with China’s General Administration of Customs, and ask about which documents are needed. We will also launch all necessary response measures. There’ll be different approaches for squid, Pacific saury and fourfinger threadfin. To a certain extent, this is an administrative trade barrier. We may consider making an appeal with the WTO.

Taiwan says it may file an appeal with the WTO over the disparity in regulations. Over on the official website of China’s General Administration of Customs, Taiwanese exporters who had licenses valid to operate until next year or the year after are now listed as “suspended.” Business leaders say they fear the impact this will have on their finances.

Amid China’s continued targeting of Taiwanese seafood products, the Council of Agriculture is getting ready to launch emergency response measures. Officials say the specifics will be announced once they are finalized.

中國從去年四月開始,要求世界國輸中的產品,都必須登錄註冊,沒完成的也能補件,台灣有一百多家水產業者申請,昨天卻發現只有一家通過,等於幾乎所有水產品都被禁止輸中。對此,農委會主委陳吉仲表示,受波級的產值高達65億,不排除會向世界貿易組織WTO申訴。

中國要求輸中產品都要登錄註冊,台灣有一百多家水產公司和漁船補件了,但在中國海關總署網站發現,只有一家公司通過,形同台灣水產品幾乎都被暫停輸中。

“他有針對我們採取比較嚴格的措施,他是要求我們8月底以前完成補件,其他的國家是在明年6月30號,我想這是所謂WTO裡面,用一個行政貿易障礙。”

根據農委會統計,這波受影響的水產品,產值高達65億元,其中以魷魚占最大宗有30幾億,再來則是午仔魚、鰹魚和秋刀魚等,對水產業者衝擊很大。

“希望透過衛福部食藥署,來跟對岸的海關總局,詢問這樣的註冊議題,是不是有哪些資料可以補齊,同步來啟動所有因應措施。魷魚、秋刀魚跟我們的午仔魚,分不同樣態來處理,這某種程度就是用貿易障礙,不排除到WTO裡面去做相關申訴。”

對中國不符合常規的要求,我國不排除向世界貿易組織WTO申訴。而實際上中國海關總署網站查詢,原本明後年才到期的註冊有效期,全部都顯示"暫停進口",業者損失恐怕難以估計。

“我們會進一步跟他(中國)聯繫,但是他不一定會回覆。中國就是經常這樣子,他要一個措施禁止你進來,從來沒有說預先跟你講好,給你多少緩衝期,他不會這樣做。”

中國再度對台灣農漁產品出手,農委會正緊急研擬應變措施,確定後就會正式對外說明。
