
A new smart monitoring system has been installed on Taichung’s roads. These new “noise cameras” can catch drivers out for making too much noise on the roads. Such noise pollution is often caused by retrofitted exhaust pipes. The smart new systems might be a bit of a shock to drivers, some of whom have questions about how they can challenge an unfair ticket. We spoke to officials and lawyers to find out more.
Noisy vehicles are common on Changlong Road in Taichung’s Taiping District. Now the city’s Environmental Protection Bureau has teamed up with police to install “noise cameras.”
Environmental sound level meters are paired with license plate recognition cameras and smart monitoring stations. This is the new standard facility for noise monitoring on Taichung’s roads.

One law enforcement technology package generally costs about NT$900,000. We’ve adjusted this system slightly, so setting one up costs only NT$450,000.
In contrast, on Provincial Highway 74, also known as Taichung Ring Expressway, the equipment is much simpler. Some people wonder if the more basic version works well enough?

If a car doesn’t have a retrofitted exhaust pipe, and it gets slapped with a noise pollution notice requiring a vehicle examination, do they have any recourse?

Citizens have the opportunity to make what’s known as a “secondary appeal,” in which they’ll have a second test to check if they have broken the law or not. If a citizen doesn’t attend that, the Environmental Protection Bureau will issue a fine, and then the citizen will have to take them to court in an administrative case.
Other drivers are asking whether, if they take a day off for the examination, and later they can prove that they don’t have a retrofitted exhaust pipe and didn’t break the law, can they get compensation for their lost day off? Lawyers say that in such a case, the driver would have a burden of proof to show that their rights had been infringed by officials. In other words, compensation seems unlikely.

相較之下,警方立在台74線上的設備,真的就是簡易版,民眾質疑,陽春版的,測得準嗎?

如果車子沒改裝排氣管,卻被莫名其妙測到噪音超標,收到驗車通知單,可不可以不要去?

“給民眾叫做第二次申訴的機會,讓他透過實際再次的檢驗,可以確認他有沒有違規。如果民眾不去的情況之下,環保局因此開單處罰情形,民眾必須去走訴願、行政訴訟。”
也有車主要問,如果平日請一天假,最後證明自己的車沒有改裝排氣管,沒有違法,那可不可以申請國賠?律師解釋,民眾有舉證的義務,公務員若沒有侵害人民權利,國賠恐怕很難成立。
