A disturbing stalking incident has raised alarm bells in New Taipei’s Zhonghe District, where a woman was harassed by a strange creepy man at the end of last month. The stalker followed her from Jin He Sports Park to her apartment and even made obscene gestures, wearing a balaclava to conceal his face. The terrified victim called the police, but even now, she’s afraid to go out on her own and her neighbors have put up warning signs. Let’s find out more.
A man sneaks into an alley, walks to the end, then turns back before suspiciously putting on a balaclava and looking around. He was stalking a woman until she noticed him, at which point he bolted. This stalking case took place last month in Zhonghe District in New Taipei. This man did not only stalk her, but also made obscene advances. Even now, the victimized woman is still afraid to go out on her own.

Extreme fear, persistent insomnia. I’m still too scared to go out alone at night, and when I get home, I still have the lingering fear that there’s someone in the house downstairs.
After being arrested, the 37-year-old man, surnamed Kao, claimed he only did it because he was bored. While the police handling the case determined that his actions did not meet the criteria of the Stalking and Harassment Prevention Act—as he did not repeatedly or continuously target a specific individual—he was still referred for prosecution under charges of harassment and public obscenity.

The police actually told me that the case would be rejected. He came to my building, wearing a balaclava and staring at my house. Doesn’t that count as surveillance? Or tailing? The district prosecutor’s office has made a case, but the police have written that it does not fall under the Stalking and Harassment Prevention Act.

Since this was a one-off incident, it is difficult to determine whether it meets the statutory elements of repeated and continuous conduct under the Stalking and Harassment Prevention Act. Therefore, a warning has not been issued at this time. The party concerned may raise an objection within ten days of receiving the notice.
The community has now posted notices warning people to be careful of this person. But the victim hopes that the man will be punished by the law, so that he will learn his lesson and prevent any more innocent women from falling victim to him.

新北市中和錦和公園，上個月底，一名來女子，遭陌生男子跟蹤，不僅一路跟到住家樓下，甚至還蒙面，做出猥褻動作，被害人嚇壞報警，但被害人男友控訴，即便嫌犯有跟蹤行為，但竟然不構成跟騷罪，讓他質疑法律是不是有漏洞。
一名男子鬼鬼祟祟的走進巷弄，走到底又折返，詭異的戴上頭套、東張西望，原來他在跟蹤一名女子，直到被女子發現了，他才落荒而逃。這起發生在上個月，新北中和地區的跟騷案件，男子不僅跟蹤，還做出猥褻動作，被害女子至今不敢一個人出門。

“極度的恐懼、持續的失眠。晚上我也還是不太敢一個人出門，回到家我還是會有個陰影，就覺得有個人站在樓下這樣子。”
37歲高姓男子被逮後，聲稱無聊才做出相關舉動。警方受理報案，認定這名男子不符合跟騷法，因為未對特定人反覆或持續實施，還是有依跟騷及公然猥褻送辦。

“警方竟然跟我說所謂的不成立。那他今天到我家樓下，戴頭套盯著我家，這不算守候嗎?或是說盯梢，地檢署有成立這個案件，但警方這邊是寫不成立(跟騷法)。”

“該案行為屬單次發生，尚難認屬跟騷法反覆持續之構成要件，故暫未核發告誡書，當事人得於收受通知書十日內表示異議。”
現在社區張貼公告，要大家小心這號人物，被害人只希望，透過法律的制裁，能讓嫌犯記取教訓，不要再有無辜女子受害。
