
President Lai Ching-te on Friday put forth a new round of Constitutional Court nominees. This comes weeks after the Legislative Yuan refused to approve an earlier round of nominations. At a press briefing, Vice President Hsiao Bi-khim announced that the seven nominees include Tsai Chiu-ming, a head prosecutor of the Taiwan High Prosecutors Office, who will also be President of the Judicial Yuan. There’s also Su Su-e, a Supreme Court Judge, who is the government’s pick for Vice President. They also included scholars as well. Hsiao said she hoped the legislature would support the new list.
Vice President Hsiao Bi-khim leads the seven nominees to sit together in front of reporters. Tsai Chiu-ming, a head prosecutor with the Taiwan High Prosecutors Office, has been nominated as a Constitutional Court judge and President of the Judicial Yuan. Nominated to be his deputy is Su Su-e, a Supreme Court Judge.

There were three considerations involved in these nominations that are also expectations. The first is to protect the constitutional system of freedom and democracy and defend human rights. The second is to enhance our professional capabilities involving national security cases and ensure the nation is secure and politics is clean. The third is to continue to promote judicial reform.
Both Tsai and Su investigated and tried a major corruption case in the 1990s surrounding the Taiwanese military’s procurement of La Fayette-class frigates from France. Tsai tracked an arms dealer’s illicit funds across borders and Su was the judge to make the first ruling to confiscate the arms dealer’s family’s funds in Switzerland. The pair recovered nearly NT$1 billion in bribes and kickbacks on behalf of the Taiwanese government. Other Constitutional Court nominees include Hsiao Wen-sheng, a professor with the department of law at National Chung Cheng University, Zheng Chun-hui, a current Supreme Court Judge, Lin Li-ying, Head Prosecutor with the Taiwan High Prosecutors Office, Chen Tsi-yang, a professor with the department of law at National Taipei University and Chan Chen-jung, a distinguished professor with National Chengchi University.

The Chinese Communist Party is extremely proactive in infiltrating, and even challenging and destroying our constitutional system, so we need an extremely sound and complete system. The president’s expectation is that the current system of the separation of the five powers needs to be maintained so we hereby especially hope that our legislators from all parties can uphold professional considerations.
Lai’s previous Constitutional Court nominees were all rejected by the Legislative Yuan. Hsiao called on the legislature to support and protect Taiwan’s democracy.

總統賴清德先前提名的大法官人選,遭到立院封殺,副總統蕭美琴,今天公布7位大法官被提名人,以及司法院長蔡秋明、副院長蘇素娥,這次名單包括2位法官、2位檢察官及3位學者,蕭美琴希望立法院朝野能共同支持。
副總總蕭美琴,帶領七位大法官被提名人一起亮相,現任高檢署主任檢察官的蔡秋明,被提名為大法官及司法院院長。副手則是現任最高法院法官蘇素娥。

“這次提名做了三個考量也是三個期許,第一守護自由民主的憲政制度、捍衛人權。第二提升國安案件專業能量,確保國家安全及廉能政治。第三持續推動司法改革”
兩人都辦過拉法葉案,蔡秋明跨國追討汪家財產,蘇素娥是首度判決,沒收汪家在瑞士資金的法官,兩人為政府追討回近百億的佣金。大法官被提名人,包括中正大學法律系教授蕭文生、現任最高法院法官鄭純惠、高檢署主任檢察官林麗瑩以及台北大學法律學系教授陳慈陽、政大特聘教授詹鎮榮。

“中共非常積極的滲透,甚至是對於我們,憲政體制的挑戰跟破壞,那我們也需要有非常,健全以及完善的制度。對於總統的期許,就是我們現在的五權分立的這個制度,還是需要被維護,所以還是在這邊要特別希望,我們的朝野各黨的立法委員,能夠秉持著專業的考量”
不過,先前總統提名的大法官人選,都被立院封殺,蕭美琴呼籲立院支持,守護台灣民主。
