
Three days after the death of an EVA airline’s flight attendant was made public, a legislative hearing was held Wednesday morning with top officials of the labor, transportation and health ministries. Meanwhile, EVA airline’s Union also held a protest outside the Legislative Yuan to draw public attention to the company’s leave policy for cabin crew, which discourages flight attendants from taking sick days. Protestors say the current case is the tip of the iceberg of many shortcomings in current labor laws.

If you take a certain number of days off, they’ll call you in to attend a disciplinary meeting, and during which they’ll remind you to take care of your health. Of course I know I should take care of my health, I don’t think we should be reminded of that.

I’ve been on this job for 31 years. Over the years I’ve witnessed the company appearing to loosen its authoritarian grip, and there was even a strike very recently. We had hopes then and believed that the company would improve, but it all proves to be futile and we’re so very disappointed.
They also offered flowers to the flight attendant that passed away. Three days after the incident was made public, EVA Air has yet to make any response to the union’s request for the company to improve its leave policy.

We’re ordering EVA Air to really reflect on this case and improve upon their practices, including their standards of procedure for routine operations and contingency responses. We also want them to clarify whether their practices in effect coerces employees against taking days off.
At the legislative hearing, the general-director of the Civil Aviation Administration says they’ve already assigned officials to investigate whether the EVA Air inflight supervisor had complied with regulations in reporting the flight attendant’s condition at the time, and that they will press the airline to submit a written report on the situation.

It’s unreasonable for a worker to lose the month’s full attendance bonus if they only took sick days. Having workers grit their teeth through the day while they should’ve taken it off to recover from illness shouldn’t be seen as something that adds to a company’s productivity.
Under current laws, an employer could be fined up to NT$1.5 million for refusing a sick leave. However, bonuses, including for full attendance, are left entirely up to the employer’s discretion. The recent case at EVA Air reveals how companies can still manipulate salary structures to disincentive, and even coerce workers from exercising their rights, highlighting the urgency of better labor protection.

民航局表示,已派員去長榮了解當事航班的作業情形,確認座艙長沒有依規定通報,後續將督促長榮,進快交出檢討報告。
