Two families to pay NT$600,000 after teen’s fireworks set cars on fire

Earlier this year two junior high school students, who are cousins, accidentally set two cars on fire while playing with fireworks during the Lunar New Year break. After the incident, their families reached a settlement with the owner of one of the cars, but the other instead filed a lawsuit for compensation. The court has now issued its ruling, ordering the parents of the teens to pay NT$600,000, which they say is too high. Let’s hear more.

I think it’s far too much. I don’t know. I don’t think the ruling is reasonable. According to the legal aide’s estimate, the depreciated value of the car would be about NT$290,000 to NT$300,000.

If the cars are burnt badly, there’s no way to tell what their mileage is. So in that case we look at the vehicle’s registration data, the market’s residual value and calculate a price. I think using that market price is reasonable, NT$600,000 is OK for two cars. I would even say it’s generous. Based on the photos I saw, it would be at least NT$700,000 to NT$800,000.
One of the parents says that since the car was owned for three years at the time of the incident, the amount required for fair compensation shouldn’t be so high. The fathers of both teenagers were recently laid off and are currently unemployed, which makes them financially unable to bear the cost. They say their kids learned the lesson, and hope that the compensation can be negotiated again. Though there are formulas to calculate depreciation, repair costs could actually exceed the vehicle’s value.

今年大年初一，基隆兩名國中生施放沖天炮，導致兩輛車燒成火球，事後，家屬雖然和其中一名車主達成和解，但另一名車主堅持提告求償，法院最新判決出爐，認定2名少年的父母，付連帶責任，要賠償60萬元，對此，家屬哀怨，認為賠償金太高。

“我覺得太多了，我不知道，因為我對這個判決不是覺得很合理，法扶律師有大概算說，現在那台車的折舊價應該是落在29、30萬左右。”

“燒成這樣子，我們也沒辦法判斷這台車公里數跑多少，那就以車籍資料，然後以市面殘值，然後我們就都會有一個行情價，用這個行情價來做賠償。這兩台車賠60萬還OK啦，還算法官很有良心，如果以我剛剛看到相片來講，應該(賠)七八十萬跑不掉。”
其中一人的家長認為，車子已經開了3年，折舊價格換算下來，不需要賠那麼多，加上兩個家庭的父親都被資遣、目前失業，經濟狀況根本無力負擔，認為孩子們已經得到教訓，也感到抱歉，只希望賠償金額可以再協調。其他修車廠則表示，雖然折舊率有固定換算公式，但光修理費，就可能會超過車輛殘值。
