20 Taiwanese investors in Cambodian real estate project yet to receive units

Reports of Taiwanese people falling for human trafficking scams in Cambodia have recently captured headlines in Taiwan. But that is not the only source of tensions between the two countries in recent days. Up to 20 Taiwanese buyers have been affected by a real estate investment dispute in the Southeast Asian country. The buyers had purchased 30 units at a luxury development in Cambodia’s capital, giving millions to the land developer. The building complex was scheduled to be finished in 2023, but as of August, the construction site remains empty.

Back in 2016, Cambodia’s Royal Group announced a landmark twin-building project in Phnom Penh, called “The Royal One.”

The project comprised two high-rises 62 floors tall, offering 533 units. It was set to be the tallest building in the capital, affording stunning views over the Mekong River. Many Taiwanese firms invested in the project, which ended up coming to nothing.

Royal Group has been dubbed Cambodia’s richest conglomerate. But notoriety brings scrutiny. I think it was because of political reasons, but in late 2019, a raid was conducted at a nightclub related to the group. They found a huge amount of drugs. So the conglomerate was investigated, and more than 300 people were arrested. With the upper ranks all taken away, the group had its days counted.

A Taiwanese businessperson in Cambodia says Royal One fell from grace after it was exposed by the government. Back in 2016, the group’s vice chairman Kith Thieng had traveled to Taiwan to sign a sales contract with a local real estate agency. The project’s groundbreaking ceremony was held in 2019, with completion scheduled for 2023. But as of Aug. 18 this year, the construction site remains empty.

Reports say about 20 Taiwanese buyers have been affected. They had purchased a total of 30 units, to the tune of about NT$7.5 million per unit. They had paid down payments, contract fees and about 31% of the total cost of the units to the developer. But now that the project is delayed, the Cambodian developers and Taiwanese sales agents are engaging in a complicated transnational legal battle.

If the Taiwan agent has already engaged in the deal and shared profits it could be considered an accomplice in the case and could have to bear criminal responsibility in accordance with the Banking Act of the Republic of China.

And property disputes are not the only source of tensions between Cambodia and Taiwan. According to Minister of the Interior Hsu Kuo-yung, about 370 Taiwanese are stuck in Cambodia after falling victim to human trafficking scams. Amid suggestions that Taiwan’s government should pay ransoms to rescue the victims, Hsu says that doing so would just be a temporary solution that wouldn’t actually solve the problem.

Our nation’s position and our government’s position on the matter is just like that of any other country in the world. We will not pay ransoms. We cannot negotiate with criminals like that. Otherwise, these kinds of cases will never stop arising.

The minister said Taiwan would not negotiate with criminals, saying that money would not solve the problem. He added that Taiwan would continue cooperating with other countries to find solutions. The real estate dispute is just another layer of complexity to an already complicated situation.

柬埔寨求職陷阱成為台灣社會熱門話題,檢警紛紛呼籲民眾小心詐騙,但柬埔寨不只有求職詐騙,連前幾年最熱門的房地產投資也驚傳有詐,有台灣投資人在2016年,投資由柬埔寨首富"皇家集團"打造的豪宅建案,付了大筆錢,但6年過去了,建案基地還是空地。

預計興建2棟62層的摩天大樓,共533戶,不僅是柬埔寨第一高樓,還可眺望湄公河,不少台灣人跨海投資,血本無歸。

“因為皇家集團就是號稱我們柬埔寨的首富,但是也是因為樹大招風啦,我覺得這是被政治清算,2019年他底下夜總會被發現大量毒品,所以整個皇家集團,被調查、被逮捕超過3百人。其實你想,高級幹部都被帶走,那這個集團也差不多了。”

當地台商透露,原來是柬埔寨首富之稱的皇家集團,被政府清算。回顧2016年,皇家集團副總裁陳豐天,跨海來台跟國內代銷龍頭簽約,建案2019年動工,預計2023年落成,但截至今年8月18號,建案基地仍然還是空地。

根據週刊報導,在台被害屋主約20人,買下皇家一號共30戶,一戶約砸下750萬元購屋,前後陸續把訂金、簽約金,還有31%的購屋款匯給建商,沒想到卻工程延宕,如今柬埔寨建商跟台灣代銷互踢皮球,跨國官司難度相當高。

“那台灣代銷公司如果已經參與行為分擔,並且有分潤,那業務團隊也會認為是吸金集團共犯之一,也需要負擔銀行法刑責。”

而內政部長徐國勇日前表示,目前還有370位台灣人受困柬埔寨,外界質疑,政府為何不付贖金趕快救人,徐國勇認為這是治標不治本。

“我們國家的立場、政府的立場,任何一個國家的政府都一樣,我們不能付贖金。我們不能夠用這種方式跟不法分子妥協,不然這種事會層出不窮。”

強調面對不法之徒,台灣用錢解決不是辦法,將持續跨國合作。柬埔寨先爆發"求職陷阱",如今又被爆出,首富來台吸金上億,爭議再添一樁。
