Police refers bike-scooter collision on private land to civil litigation

There’s a row of houses in the Zhonglun community of Kaohsiung’s Fengshan District that open their doors directly to a public park. One of the residents bought a new scooter weighing over 120kg that she keeps parked out front. But in recent days, a kid riding a bike ran into the scooter, knocking it over. Since it was technically parked on private property, police said they can’t treat it as a traffic accident, and referred the parties to negotiate civil damages.
A pair of kids sharing a bike careen through a park, accidentally hitting into a scooter parked in front of a house. The 120kg scooter falls to the ground, along with the little girl on the back of the bike. But she quickly climbs back up and they hurry on their way. The homeowner heard the commotion and came outside to look, but only saw the scooter on the ground. The culprit was nowhere in sight.

I have no idea how it got hit. It’s ridiculous. The path here is so wide. The side, exhaust guard, tailpipe, and headlight were all damaged.
After only having the scooter for less than a year, the owner was heartbroken that it got damaged while parked outside of her home. After checking security footage, she discovered it was a kid who ran into it. But his parent was right behind, and only gave it a glance before continuing on.

The parent didn’t admit it at first, but after he saw there was a camera, he agreed to pay compensation. The estimate came out to NT$6,500, but after it came out, he said he was only willing to pay NT$3,000, claiming it might have had pre-existing damage. He said if I wasn’t satisfied, I should go file a police report.
The incident happened in the Zhonglun community of Kaohsiung’s Fengshan District, where an entire row of houses open up to a public park. The scooter was on a pathway that’s owned by the community, so it wasn’t parked illegally. But the case also can’t be considered a hit-and-run.

The incident did not occur on a public road, and thus cannot be handled as a standard traffic accident. We recorded both parties’ information and assisted in applying for mediation through the district office.
It’s not only walkways like this one, but also parking lots and other similar areas aren’t considered public roads. If an accident occurs in one of these places, it can only be compensated through civil procedures.

高雄鳳山中崙社區整排住戶家門打開就是公園，有住戶把新買重量超過120公斤的機車停在家門口，卻遭到騎小腳踏車的小朋友不慎撞倒，經查停車的的公園紅磚道，是私人土地，警方無法也無法以交通事故處理，只能轉介雙方協調民事賠償。
小朋友單車雙載在公園騎車玩耍，一個重心不穩，撞上停在家門口的機車，超過120公斤的機車居然應聲而倒，單車後座小女孩也摔倒在地，但很快就又爬起來，蹦蹦跳跳離開。屋主聽到聲音出門查看，只見機車倒地，但人已經不見蹤影。

“我也不知道為什麼會被撞，蠻傻眼的，這邊路蠻大條的，側邊，防燙蓋，排氣管，前側大燈也有(毀損)”
剛買不到一年的愛車，停在家門口卻無辜被撞倒毀損，讓車主好心疼。調閱監視器發現闖禍的是小朋友，但當時家長就跟在孩子後頭，卻也只瞄了一眼就直接離開。

“(家長)他一開始不承認，後面看到監視器(才同意賠償) ，估價單寫6500元，估價單出來的時候，他就說他只願意賠3000，說說不定之前就有車損，他說不願意接受就叫我們去報警”
事發地點在高雄鳳山中崙社區，整排住戶家門打開就是公園。而受害車主家門口的公園紅磚道，經過確認屬於社區私人土地，停車沒有違規。而小朋友撞了就跑，也不能算肇逃。

不只是這次事件中的公園步道，像是停車場等也都不是一般道路，一旦發生車禍碰撞，只能走民事毀損賠償。
