
Feuding between the Executive Yuan and opposition parties seems to have no end in sight. This time it’s over a pension reform plan initiated by former DPP president Tsai Ing-wen. The KMT and TPP recently used their majority to put a halt to Tsai’s cuts to pensions for the military, officials and teachers. But the government opposes the suspension, saying that it will strike a severe blow at the nation’s coffers. As the Constitutional Court has resumed operations, the Executive Yuan will countersign the bill and then immediately petition the constitutional court for an interpretation.
The opposition controlled Legislative Yuan has passed a bill halting a Tsai-era pension reform that the Executive Yuan planned to not promulgate. But now that the Constitutional Court is operating again, it’s taking a new approach.
The Executive Yuan has decided to countersign this bill but not put it into force. Instead it will file a petition for a constitutional interpretation. As for the option of requesting the legislature to reconsider the pension bill, as previous requests for reconsideration were never supported by opposition parties, the Executive Yuan has decided not to take this route.

Today is the deadline for the president to promulgate the anti-pension reform bill proposed by the Legislative Yuan. These anti-pension reform amendments violate Article 70 of the Constitution. However, since the Constitutional Court has resumed normal operations, after the president’s advisory document arrives, the Executive Yuan will fulfill its obligations and responsibilities. We will countersign the bill to allow it to take effect and immediately submit it to the Grand Justices for a constitutional interpretation.
Former DPP President Tsai Ing-wen promoted a pension reform with cuts that helped over NT$80 billion to be injected into the civil service retirement fund in recent years. The reforms also delayed the expected bankruptcy date from 2031 to 2050. Now that the KMT and TPP have joined forces to reverse the reform, the move is expected to have a serious impact on public finances, leaving the Executive Yuan with little choice but to respond.

The Constitutional Court has resumed operations, and we certainly expect it to act as the ultimate guardian of the people’s rights. It would be the most urgent task at hand to submit the pension reform case to the Constitutional Court for interpretation and to request a temporary injunction. As for whether and how to implement it, that needs to be discussed by the Executive Yuan, the Examination Yuan, the Ministry of Education, and even with local governments.
The opposition has tried to block the government’s pension reform. The Executive Yuan is now striking back.

藍白兩黨日前以人數優勢,三讀通過停砍年改法案,原本年改讓破產時程從2031年延長到2050年,如今走回頭路恐衝擊國家財政,政院原本有意按照財劃法,採"不副署不執行",但上週五憲法法庭重啟,傳出政院將採"副署不執行"並聲請釋憲,行政院會後記者會上,發言人李慧芝證實這項消息。
藍白先前以人數優勢,三讀通過停砍年改法案,原本政院打算比照財劃法模式,採"不副署不執行",但因憲法法庭已在19號正式重啟,態度出現轉變。
對於停砍年改法案,政院定調"副署不執行",並聲請釋憲。至於覆議部分,由於先前多次提出都被在野黨杯葛,因此政院傾向不提覆議。

“立法院提出的反年改案,今天(12/26)是總統公告的最後期限。這項反年改修法,違反了憲法第70條的規定,但既然憲法法庭已經恢復正常運作,稍晚等總統府的諮文到之後,行政院會履行義務跟責任,我們會副署讓它生效,也會即刻送請大法官解釋。”
政院給出"副署不執行"原因,而前總統蔡英文推動年改,這幾年光公務員退撫基金就節省、挹注了800億以上,也把破產時程從2031年,一口氣往後延到2050年,如今藍白聯手讓年改走回頭路,勢必衝擊國家財政,政院不得不出手。

“憲法法庭已經恢復運作,我們當然期待憲法法庭,能夠作為人民權益最終的守護者,那將年改案交付釋憲,並且聲請暫時處分,我想這是眼前的當務之急。至於後續是否執行、如何執行,都需要讓行政院、考試院、教育部,乃至於要與各地方政府來商議。”
藍白聯手停砍年改,政院祭出反制措施,朝野隔空互槓。
